Brockton MA— Criminal charges against former Brockton High School choral director Matthew Cunningham have been dismissed after the alleged victim declined to testify, according to court officials.
The decision to drop the case came after the alleged victim invoked their Fifth Amendment right, leaving prosecutors unable to move forward. The case was dismissed due to a lack of prosecution.

Cunningham, a longtime music educator at , was arrested in August 2025 following an investigation involving local police and federal authorities.
Prosecutors had alleged that Cunningham met an underage male in April 2025 and engaged in a sexual encounter. Authorities also claimed a payment was later made through a mobile payment platform, which raised concerns and triggered further investigation.
Investigators said the two initially connected through a dating app. The defense maintained that Cunningham did not know the individual was underage.

Cunningham initially faced multiple serious charges, including:
- Trafficking a person for sexual servitude
- Sexual conduct for a fee
He pleaded not guilty following his arrest and was released on bail.
In November 2025, prosecutors dropped the more serious trafficking charge. The remaining charge stayed active until this week, when it was dismissed after the alleged victim declined to testify in court.

Following the arrest, placed Cunningham on administrative leave. Officials later confirmed he is no longer employed by the district.
